The Role of the Borough Clerk

The Borough Clerk serves as the backbone of local government operations and acts as a bridge between the public and government officials. The Clerk serves as Secretary to the Municipal Council and is the Custodian of the municipal seal, all minutes, ordinances, resolutions, contracts, deeds and archival records of the Borough. Under the Clerk, a variety of vital records, pet registrations, liquor licenses, hawking and peddling, towing, taxi-limo, raffle/bingo permits, etc. are processed. This office is impartial and apolitical in dealing with Public Officials and Citizens in election matters and is here to provide general information to the public.

Some of the many Statutory duties of the Clerk include:
  • Preparation of meeting Resolutions, Ordinances, Agendas, and meeting Minutes.
  • Advise the Council on applicable Statutes, including the Open Public Records Act
  • Responsible for OPRA requests (Open Public Records Requests)
  • Accepts legal documents on behalf of the Borough
  • Maintains custody of official documents, responsible for local archives, including records storage, retention, and destruction, in accordance to Statute
  • Insure compliance with Financial Disclosure Statements
  • Maintain receipt of Landlord/Tenant Registrations
  • Oversee the Primary, General and School Board Elections; including accepting, certifying and maintaining receipt of Nominating Petitions; securing Polling Locations

The Clerk is also a Notary and is available to notarize documents for residents at no/charge.

Daniel's Law

On November 20, 2020, Governor Murphy signed Daniel's Law (P.L. 2020, c.125) into law. Daniel’s Law was enacted in response to the tragic death of Daniel Anderl, the son of Judge Esther Salas and Mark Anderl. The law prohibits disclosure of the residential addresses of certain persons covered by the law (“Covered Persons”) on websites controlled by state, county, and local government agencies. The community of Covered Persons includes former, active, and retired judicial officers, prosecutors, and members of law enforcement and their immediate family members residing in the same household.

Individuals covered under the law may register through the Daniel's Law Portal, (click on the blue side) which was recently established by the Office of Information Privacy, an agency created within the New Jersey Department of Community Affairs to carry out the mandate of Daniel’s Law.

With respect to Internet postings other than those on New Jersey state, county, and municipal government websites, an authorized person, as defined by law, seeking to prohibit the disclosure of the home address or unpublished home telephone number of any covered person shall provide written notice to the entity or person advising that they are an authorized person and that they are requesting that the entity or person cease the disclosure of the information and remove the protected information from the Internet or where it is otherwise made available. See, N.J.S.A. 2C:20-31.1(c) and N.J.S.A. 56:8-166.1(a)(2).
